WHAT IS CONSIDERED A FELONY IN PENNSYLVANIA

A felony is a much more serious charge than either a summary offense or a misdemeanor. The penalties are much higher upon conviction.

Usually the nature of the crime determines whether it is classified as a misdemeanor or felony. However, the prosecution can also take into account previous criminal history, the number of victims and extent of the crime to make a classification.

Typically crimes like sexual assault, rape or ISDI, high value theft or fraud crimes, aggravated assault, kidnapping, sexual assault of a minor, and drug crimes (possession with intent to deliver) will fall under a felony.

Felony Classifications and Penalties for a Felony Conviction

Depending on the type and nature of the crime, felony charges are fall under three categories: first-degree, second-degree and third-degree.

The standard penalties for each of the felony classifications are as follows:

  • First-degree Felony: Up to 25 years in prison and a $25,000 fine.
  • Second-degree Felony: Up to 10 years in prison and a $25,000 fine.
  • Third-degree Felony: Up to seven years in prison and a $15,000 fine.

Penalties can increase if multiple crimes are involved, for each charge, or if this is a second or multiple offense.

Crimes more serious in nature can also cause punishments to increase. For example, rape of a victim under 13 years of age is a sentence of 40 years in prison, but can also lead to life in prison, depending on circumstances of the crime.

There are also crimes that are non-categorized, like Murder/Homicide.
